Golan v. Gonzales: How Copyright Restoration Alters the Ordinary Copyright Sequence and Invites First Amendment Review

If you have access to either Westlaw or Lexis/Nexis, I’m now published there!

Last semester, I wrote what is called a “Case Note” on a recent Tenth Circuit decision, Golan v. Gonzales, which is an interesting case involving the intersection of the First Amendment and Copyright Law. Basically, works that were once in the public domain (freely usable by anyone) were taken out of the public domain, and the copyright holders sought to prevent certain individuals from doing things like publicly performing musical arrangements derived from public domain symphonies and selling copies of fairly old movies.

If you want to look and you have access, here are the citations:

Westlaw: “10 tlnjtip 353”

Lexis: “10 Tul. J. Tech. & Intell. Prop. 353
